General Terms and Conditions (GTC)

for the online shop www.nordicbabymilk.de

§ 1 Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers as defined in § 13 BGB (German Civil Code) via the online shop www.nordicbabymilk.de with CKS GbR.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

(3) Deviating conditions of the customer are not recognized, unless CKS GbR expressly agrees to their validity in writing.

§ 3 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) By clicking the "Order with obligation to pay" button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

(3) The receipt of the order is automatically confirmed by email. This order confirmation does not yet constitute an acceptance of the offer.

(4) The purchase contract is only concluded upon an explicit order confirmation or upon shipment of the goods.

§ 4 Prices

(1) All stated prices are in Euro, including statutory value-added tax.

(2) Any additional shipping costs will be shown separately in the ordering process.

§ 5 Payment Methods

The following payment methods are available:

• PayPal
• Prepayment by bank transfer

For prepayment, shipping takes place after receipt of payment.

§ 6 Delivery

(1) Delivery is exclusively within the European Union.

(2) Shipping is carried out by DHL.

(3) Delivery times can be found on the respective product page.

(4) Should an item unexpectedly not be available, the customer will be informed immediately. Payments already made will be refunded without delay.

(5) Partial deliveries are permissible, provided they are reasonable for the customer.

§ 7 Retention of Title

The delivered goods remain the property of CKS GbR until full payment has been received.

§ 8 Warranty

The statutory warranty rights apply.

§ 9 Liability

(1) CKS GbR is liable without limitation for damages resulting from injury to life, body, or health.

(2) For other damages, CKS GbR is only liable in cases of intent or gross negligence and for the breach of essential contractual obligations. In these cases, liability is limited to the typical, foreseeable damage, as far as legally permissible.

(3) Liability under the Product Liability Act remains unaffected.

§ 10 Food and Baby Food

(1) Infant and baby food is a foodstuff within the meaning of food law regulations.

(2) The product images are for illustration purposes. The information on the respective product packaging, in particular regarding ingredients, allergens, nutritional values, and instructions for use, is decisive.

(3) The customer is requested to check the goods for obvious transport damage immediately upon receipt and to report such damage to the shipping service provider and CKS GbR as soon as possible. The statutory warranty rights remain unaffected by this.

§ 11 Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

The details can be found in the separate withdrawal instructions and the sample withdrawal form.

§ 12 Contract Language and Contract Text

(1) The contract language is German.

(2) The contract text will be saved after the contract is concluded. The customer will receive the order details by email.

§ 13 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as this does not conflict with mandatory consumer protection regulations of the state in which the consumer has their habitual residence.

§ 14 Final Provisions

Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
